UPDATE 8/25: In a statement, the Monroe County District Attorney said, “We still have an open investigation within our office, but right now our intention is to retry Jose Torres for the murder of Miguel Cruz.”
ORIGINAL: A judge has vacated a murder conviction of a man whose case News 8 has been following for months.
Jose Torres was convicted based in large part on his confession to the shooting of Miguel Cruz in July of 2001 on Hollister Street. Torres says he doesn’t remember confessing and was drunk and high at the time.
Years later, a new witness identified Angel Carrasquillo as the real killer, and Carrasquillo himself says he was the killer.
Monroe County prosecutors could now call for a new trial with the new evidence.
