New York state’s ban on flavored e-cigarette and vaping products was scheduled to go into effect Friday, but now that ban is being delayed by state courts.
Officials from Vapor Technology Associated are claiming victory after a New York State Appellate Division Court granted a temporary restraining order Thursday in a lawsuit the VTA and other pro-vaping affiliates lobbied against the state.
Four appellate judges ruled that the state is “temporarily enjoined and prevented from enforcing” the flavor ban until a ruling on the motion for a preliminary injunction is determined.

Your Friday will start off rather gloomy with a solid deck of low cloud along, areas of windswept light rain and drizzle off of Lake Ontario. The rain gear is a good idea early this morning thanks to the lake enhanced rains coming in on those northerly breezes.
You’ll notice that brisk northerly flow throughout the day which will, unfortunately, slow the clearing process down a bit here in Rochester. Still, with enough dry air, I still believe that we’ll see breaks of sunshine before the day is out. Today’s temperatures will be woefully low for early October. Normal highs right now are in the middle 60s. Temperatures today will struggle to get beyond 50 degrees much of the time with the warmest part of the day actually going into the books as of the morning.
