Naples man arrested for aggravated DWI with .40 BAC

A Naples man is arrested for having a blood alcohol content of five times the legal limit.

On Tuesday at approximately 8 p.m. 54-year-old James Rathbun was stopped on Plank Road (Route 15A) in the Town of Livonia for alleged vehicle and traffic law violations.

A Deputy Sheriff arrived on scene to conduct a roadside DWI investigation.

Rathbun was subsequently arrested for DWI. He was taken to the Livingston County Jail where a breathalyzer test on Rathbun was conducted.

The test results revealed a BAC of .40, which is five times the legal limit.

Rathbun was additionally charged with aggravated DWI. It was further discovered that Rathbun had been arrested on April 28 in the Town of Cohocton for aggravated DWI.

Rathbun was arraigned on May 3 in the Town of Livonia Court and was sent to jail on $500 cash or $1,000 bond.
