The District Attorney has filed a motion to re-try Charlie Tan.

Tan is the Pittsford teen who was tried on a murder charge in the death of his father, Jim Tan. Prosecutors say he shot and killed his father in their home in February of 2015.

A jury could not agree on a verdict and in November, the judge dropped the case after it ended in a mistrial.

But now, prosecutors have filed a legal motion for a new trial.
