A convicted killer serving several life terms was re-sentenced Friday for his attempted murder conviction.
Frank Garcia received the maximum sentence of 25 years to life in prison for the crime.
Garcia is already serving four life sentences at Attica Correctional Facility for murdering four people on February 14, 2009. The original fifth sentence was overturned earlier this year.
Audra Dillon, the attempted murder victim, said she struggles every day from severe post-traumatic stress disorder after watching the love of her life murdered before her eyes, along with another victim.
Dillon says Garcia shot her twice from close range while she was in her car, and that having to leave the two victims behind while she went to get help still traumatizes her.
After telling Judge Sam Valleriani how greatly this has altered her life, Garcia spoke on his own behalf – maintaining his innocence and telling Dillon she was wrong about who shot her.
“If you all had seen how close he was to me, there’s no error, said Dillon. “So I don’t know why he said that, but I definitely saw him, as of today and as of 8 years ago, no difference. I know it was him”
Dillon said the most upsetting part remains that Garcia refuses to accept responsibility and that he has continued trying to appeal the decision.
