Rochester City Court Judge Leticia Astacio goes back to jail

Astacio is being held the Livingston County Jail

ROCHESTER, N.Y (WROC) - It's a scene we've seen before. Judge Leticia Astacio walking into court -- and not coming out. 

Astacio appeared in front of Canandaigua City Court Judge Stephen Aronson. It was not a happy ending.

"At this time I would order the defendant held without bail until the hearing day," Aronson said. 

Astacio's next scheduled hearing will be the day the court decides if she has violated her probation terms. Defense Attorney Gregory Salmon made one final plea in court before his client was handcuffed.

"I would ask that the court allow my client to remain out of custody so I can speak with my client and adequately prepare the defense for the hearing scheduled for next week," Salmon said. 

Aronson denied his request. Prosecutor Zach Maur weighed in on the judge's decision. 

"It's easy to speculate that at this point we have seen multiple violations. While there was already an original violation still pending, I would suspect that played into his decision," Maur said. 

There are four pending violations. The latest one -- leaving Monroe County without permission from her probation officer. Astacio's attorney tells News 8 she had permission to leave for another reason. 
     
"My client had permission to leave the county, where my client goes after she leaves the county is not something she needs permission for. My client left the county with permission so what are we doing this for?" Salmon said. 

Maur tells News 8 they never requested for Astacio to go to jail.  

"But of course you reach a certain point where if she isn't going to comply with the terms and the conditions imposed an alternative may need to be unfortunately the only alternative we have at this point is incarceration."

Astacio's attorney filed a motion for her probation, but that was denied. For now Astacio is being held in Livingston County Jail without bail until her next hearing. 

She is schedule to appear in court Novemeber 3, 2017 at 1:00 p.m.
