Penfield Town Board set to purchase Shadow Pines amid controversy

PENFIELD, N.Y. (WROC-TV) - After two years, the Penfield Town Board has finally purchased the Shadow Pines property.

While many residents support the purchase, some tax payers aren't happy about the way the 
transaction went down. 

Town Supervisor Tony LaFountain had originally stated that he wanted voters to decide whether the town should buy Shadow Pines.  

"Our desire was to have a public referendum vote," LaFountain said. "An up or down vote by our residents."

But in order to make the $3.65 million deal happen by the January deadline, LaFountain says that wasn't possible.

"As part of our negotiations with the seller, we've been put in a position that we could not do a public referendum and still meet their requirements for a closing date," LaFountain said.

When the property frst went up for sale, the plan was to build housing. In response to public outcry to save the green space, the town put a moratorium on the project. Then, this October, the town announced their intent to purchase the land.

Homeowner John Wilkie said when the public referendum was taken away, so was his voice.

"And we're saying, no no no no no," Wilkie said. "No matter what the reason is, no matter how come they feel justified, the vote is our number one thing. Once we give it up, i don't like what happens after that." 

LaFountain said he'd honor a petition for a public vote if it gets enough signatures, and subsequently, ask for more time from the seller. 

There will be another meeting at 7 p.m. Wednesday, Dec. 6 where residents will be able to share their concerns with the Penfield Town Board.
