DA: 10-year-old Churchville boy died of fentanyl overdose

ROCHESTER, N.Y. (WROC-TV) - A mother and her boyfriend were arraigned Thursday after an unsealed indictment charged them with manslaughter in the death of a 10-year-old boy back in June. 

On June 12 around 9:30 p.m., deputies say J'Vieon Grayson-Sutton was found unconscious by six-year-old brother in their Fitch Street home in Churchville

The six-year-old went to a neighbor's, who called 911. The 10-year-old was taken to Strong Memorial Hospital, where he died the next afternoon. 

Dolfona Grayson and Walter Morse were both charged with felony second-degree manslaughter.

During the initial investigation, deputies said the mother was at work and the six-year-old's father was watching the kids, but left the house to run errands.

Morse was also arraigned on 14 other criminal charges, including attempted murder in the first degree, assault in the second degree, and two counts of criminal possession of a weapon. Morse is accused threatening to kill the 10-year-old's biological father who was cooperating with police in the investigation. 

"On October 19th in the City of Rochester, Walter Morse attempted to kill Michael Coles who was a witness in an ongoing criminal investigation," said Assistant District Attorney Sara VanStrydonck.

According to the felony complain, Morse allegedly shot Coles three times in order to prevent him from providing police information in the boy's death.

Grayson was released and is required to wear an electronic monitoring device. 

Morse will remain in jail without bail.

Both are due back in court on Feb. 2.
