MONROE COUNTY (WROC) - Manslaughter charges against the mother of a 10-year-old who died of an overdose in Churchville have been dropped.
Prosecutors say a judge has dismissed the charges against Dolfona Grayson. According to the court decision, Judge John DeMarco ruled there wasn't enough evidence showing Grayson was aware of the extent of the risks that led to the boy's death. As a result, he granted a motion by the defense to dismiss the manslaughter charge.
Grayson and her boyfriend Walter Morse werecharged after 10-year-old J'Vieon Grayson-Sutton died last June. Prosecutors said the boy was left at home alone with his younger brother and was exposed to white powder that was later determined to be fentanyl.
Deputies say Grayson had left her kids with Morse who then left the home himself -- leaving the six-year-old and ten-year-old boys on their own.
Deputies say the six-year-old later found his brother unresponsive and ran to get help from a neighbor.
Morse was also charged in the case.
